As a condition of selling items in a Just Between Friends Consignment Sale, I represent, warrant and agree that the following are true and correct in all respects:

• I am participating in the Just Between Friends Consignment Sale Event as a Consignor / Team Member.
• I, understand and agree that Just Between Friends (JBF) Clay County and Just Between Friends Franchise Systems, Inc. are not responsible for fire, loss, theft or damage to the items I am consigning.
• I also understand that JBF Clay County is only a broker or agent for the Consignor. JBF Poconos has no obligation to pay for unsold items. Title possession remains with the Seller.
• I understand that I will earn 60% of the gross sales actually received by JBF Clay County for the items I offer for sale.
• I understand there is a $15 Consignor Fee which will be deducted from my consignor check.
• I understand that I will receive an echeck to the email registered on myjbftags.com, within 2 weeks of the sale ending, in the amount of my gross sales.
• I understand that there is a 90-day window to retrieve and deposit my check. After that time, a $35 charge will apply to place a stop on the original payment and reissue.

• I understand that clothing going through Inspection at Drop off which is deemed "no-thank-you" is bagged and available for me to take home before I leave the building. No-thank-you items not picked up the day of your Drop off appointment is automatically donated. We are not able to save or hold these no-thank-you items.
• I understand that Consignor Pick up (of unsold items you choose not to donate) is on Sunday, Sept 8, 2024, from 7pm-9pm. Doors will remain locked until 7pm unless otherwise stated.
• I understand that any item(s) not picked up by 7:01pm on Tuesday, October 22, 2024, will be donated to the JBF Charity Partner, Presbyterian Social Ministries or Hope4Veterans.
• I understand that items that are off-season, stained, broken, missing pieces or missing batteries will be rejected at the discretion of JBF Team Members and Staff.

• I understand JBF Clay County will sell the items I am consigning for the price listed on the barcode tags I have created. I understand that the price sold will be controlled by the printed tag attached to the item & not any subsequent changes online.
• I understand if my item is marked full price, it will only be sold at full price; if my item is marked to reduce, it will be sold at 50% off during scheduled discount hours, and 75% off items marked both reduce AND donate for sort team employees after the sale ends and their sort shift is completed.

• I am the owner of the items I am consigning/selling and I have full authority to sell the items offered by me for sale
• I verify that no item I am consigning is the subject of any current, pending or threatened recall notice according to the Consumer Products Safety Commission.
• Each item is clean and sanitized, in good operating condition & is not defective, broken or damaged in any way. If any item is returned because it is defective, is missing parts or does not work, I will not be paid any amount for the sale of that item.
• I know of no reason why any item offered for sale by me would cause injury to another

• I understand that by appearing in a public venue as a shopper or consignor, JBF has my permission to use my image in any JBF publicity avenue they choose, & I agree that no royalty or other payment is due me because of the use of any such image.

• I understand that a “star” (printed on JBF tags with any color ink) means that the item will remain at FULL PRICE throughout the sale. Tags with no star will be sold at 50% off starting at the 1/2 Price Pre Sale until the sale ends.

• If I am helping at the sale, I will arrive 10 minutes early for my shift so that I can park my car and be ready to participate. If I am unable to fulfill my full team member commitment and am unable to find a replacement, I will notify Lori Rodden on HomeBase. I will check in and out at the Team Member Check-In area.

• I am participating in an ethical manner and agree that I am not attempting to learn the business practices of JBF, operations, techniques, or any other business matters that may or may not be trademarked, registered or proprietary in any way.

By registering to participate, I confirm that: (1) I have read & fully understand this Consignor Agreement & Liability Waiver, including the Representations & Warranties stated above;

By registering for my drop off pass, I confirm that: (2) I agree to and warrant as stated above; & (3) no one has made to me representations, statements, or inducements that change or modify anything written in this Consignor Agreement & Liability Waiver.
